Constitutional Court finds ruling coalition favoured politicians, oligarchs in criminal law amendments

The panel of judges say that they had to overlook such scenarios.

Prime Minister and leader of the Smer party, Robert Fico, has described the decision of the Constitutional Court regarding the amendment of the criminal laws as a 100:0 victory over the “hateful opposition.” However, the court’s decision, published in full on July 19, tells a different story.

“The prosecution of a specific act is either barred by the statute of limitations after the amendment to the Penal Code takes effect, or it is not, and this must be assessed ad hoc regardless of which assessed time period between actions interrupting the statute of limitations applies. If the prosecution is barred by the statute of limitations, the prosecution of the accused must be stopped,” said Professor Jozef Čentéš, head of the Department of Criminal Law at Comenius University.
