Canon law
The field of Habilitation and Inauguration "Canon Law" mainly comprises the following segments in the area of Canon Law (the science of Canon Law) and in the area of education in the study field “Law”:
- the history of Canon Law;
- the theory of canon law;
- the hierarchical structure of the Catholic Church;
- eastern catholic canon law and its relations to the law of the Latin Church;
- canonical criminal law;
- canonical procedural law;
- canon law of marriage;
- magisterial and sacramental law;
- concordat law.
Canon law is the legal system of the Catholic Church, which is the world's largest organisation with more than a billion members. It can be defined as the body of norms issued or confirmed by a competent ecclesiastical authority in order to order and protect the life of the ecclesial community, as well as to safeguard the rights and enforce the duties of the believers.
Some sources of canon law also have significant overlaps into the national law of individual countries. We are thinking in particular of the sources of concordat law, which takes precedence over universal canon law, while its place in the hierarchy of sources of a given state is determined by national legislation. These sources also have a significant influence on the further development of national law, providing it not only with limits but also with a guarantee of value, not only in the development of confessional legislation.
The object of study of Canon Law is the relations between the ecclesiastical authorities of the Catholic Church, the relations between the ecclesiastical institutions and the individual members of the Church, the relations between the individual believers and the relations between the Catholic Church and states or other subjects of public international law.
Within the field of Canon Law, interdisciplinary relations can be reflected in particular in finding the foundations of modern (especially public) secular law in canon law norms, institutes or principles, as well as in the international relations developed by the Holy See as a subject of public international law.
