Constitutional law
The field of Habilitation and Inaugural procedure "Constitutional law" mainly includes the following segments in the area of constitutional law (science of constitutional law) and in the area of education in the field of study “Law”:
- State science in a legal context
- Constitutional law of the Slovak Republic
- the relationship of constitutional law to other branches of the legal order of the Slovak Republic, in particular to administrative law and criminal law
- the relationship between constitutional law of the Slovak Republic and international law
- the relationship between constitutional law of the Slovak Republic and European Union law
- international law protection of human rights and fundamental freedoms
- comparative constitutional law (comparison of constitutional systems and their individual institutes in different states, with an emphasis on states based on the principles of democracy and the rule of law, which include in particular the member states of the European Union and the Council of Europe)
- the relationship of constitutional law to other social science disciplines, especially political science
Constitutional law regulates the most important social relations within the state, relating in particular to the organisation and functioning of public authority (the issue of the separation and accountability of powers) and the foundations of the relationship between public authority and the individual (the issue of fundamental rights and freedoms).
The object of study of Constitutional Law is the organisation and functioning of public authority within the state, in particular the separation of powers at the horizontal level (form of government) and vertical level (state structure). In particular, it is specifically concerned with the creation of the supreme state bodies of the Slovak Republic (the National Council, the President, the Government or the Constitutional Court), their powers, competences and interrelationships. It also deals with issues related to the existence and functioning of direct democracy. However, the subject of examination is also the state regime, namely the various methods of exercising public authority that define the state regime.
From the point of view of sources, in addition to the Constitution of the Slovak Republic as the legal basis of the state, the subject of examination are also constitutional laws, other national legislation and international treaties covering the substantive matter of constitutional law. However, a special place belongs to the decision-making activity of the Constitutional Court of the Slovak Republic, which interprets the inherently very general and highly abstract text of constitutional norms. In addition to the decision-making of the Constitutional Court, the decision-making of the European Court of Human Rights is also subject to scrutiny, particularly in the context of the examination of the relationship between public authorities and the individual. Attention is also paid to the identification and examination of constitutional custom, which also constitutes a source of constitutional law that is, moreover, increasingly gaining in importance.
Constitutional systems and their individual institutions (e.g. the system of supreme state authorities or the regime for the protection of fundamental rights and freedoms) in other states, especially in the member states of the European Union and the Council of Europe, are also subject to scrutiny. The comparative study of constitutional systems and their individual institutes enables the design of appropriate solutions for the constitutional system of the Slovak Republic, thus the Department of Constitutional Law at the same time ensures the desired link between the academic environment and the legal (and also political) practice.
Interdisciplinary relations taken into account within the field of "Constitutional Law" mainly include legal theory, administrative law, criminal law, political science, and sociology.
