Criminal law

The field of Habilitation and Inauguration "Criminal Law" mainly includes the following segments in the area of criminal law (the science of criminal law) and in the area of education in the field of study “Law”:

- substantive criminal law

- criminal procedural law

- European criminal law

- international criminal law

- Criminalistics in its direct connection with criminal law

- Criminology in the scope of direct links with criminal law

- penology in the scope of direct links with criminal law

- expert activities within the scope of direct links to criminal law

- forensic disciplines related to criminal law (forensic medicine, forensic engineering, forensic psychology, forensic psychiatry, etc.) to the extent directly related to criminal law.

Substantive criminal law regulates the basics of criminal liability, the circumstances excluding criminal liability, the system of sanctions, criminal offences, the extinction of the criminality of an act and other related aspects of criminal liability for the commission of a criminal offence. It is the basis for any further study of other criminal law disciplines and criminal law aspects and is a prerequisite for the application of criminal procedural law as well.

Criminal procedural law is an application tool of substantive criminal law, it is the only possibility of application of substantive criminal law in practice, therefore it is an integral part of the discipline of criminal law and its knowledge is complementary to the basic framework of criminal law knowledge.

Nowadays, with the current membership of the Slovak Republic in the European Union, it is inconceivable not to incorporate into the basic theoretical knowledge the elements of European law and European criminal law, which currently significantly influences national criminal law and affects both substantive and procedural law. In recent years, alongside other branches of law, it is criminal law that has gained in importance, as it was underdeveloped in the EU in the past, and it is precisely in recent years that we have seen a trend to make up for this shortcoming, which is why European criminal law is a dynamically developing body that is currently on the rise.

International criminal law also has a permanent place in the modern criminal law, because it mainly represents the aspect of the responsibility of individuals for crimes of an international dimension, in particular war crimes, crimes against humanity and crimes against peace. The history of both the 20th and 21st centuries confirms to us time and again the importance of this part of criminal law, when war conflicts do not avoid the European continent and modern and civilised countries.

Criminalistics and criminology are disciplines that complete and deepen the framework of criminal legal knowledge. Within the framework of criminalistics, it is necessary to know the procedures of criminal investigations and thus increase the success and reliability of criminal proceedings. Within criminology, knowledge of the offender and the victim and of crime itself increases the chances of preventing recidivism, of successful prevention and of reducing crime overall.

We cannot forget about penology, which increases the effectiveness of criminal law in society by understanding the execution of punishment, its principles and policies and specific relationships arising in the execution of punishments.

Expertise and forensic disciplines are necessary for the overall success of criminal proceedings and are an integral part of the application of investigative methods and means of evidence, thus these disciplines cannot be separated from the overall knowledge of criminal law and cannot be neglected with the highest scientific and pedagogical skills.
