Labour law

The field of habilitation and inauguration "Labour Law" mainly includes the following segments in the area of labour law (labour law science) and in the area of education in the field of study “Law”:

- Labour law

- Social security law

- Health law

- the relationship of labour law and social security law to other branches of the legal order of the Slovak Republic, in particular civil law and administrative law,

- the relationship between labour law of the Slovak Republic and international law

- the relationship between labour law of the Slovak Republic and European Union law

- the relationship of labour law to other social science disciplines, in particular sociology, psychology and economic sciences

Labour law regulates social relations in the implementation of dependent work, relating in particular to the protection of the subjects of labour relations, the organisation and regulation of labour relations, the control of compliance with the rights and obligations of the subjects of labour relations, as well as the functioning of state bodies with competence for labour relations. The fundamental task of labour law in the context of the current economic order of Europe and the world is to optimise the relationship between the factors of production of labour and capital in such a way that this relationship corresponds to the needs of capital and at the same time does not contradict the human dignity of employees. 

The object of study of Labour Law is the area of individual labour law and the area of collective labour law. The third area that falls within the subject of labour law is the regulation of employment services. The area of individual labour law consists of individual relations between an employee and an employer arising in the performance of dependent work. The second area of the subject-matter of labour law is collective labour law, which acts as a protective mechanism in relation to individual labour law. It covers legal relations between employee representatives or associations of employees and the employer. The third area falling within the scope of labour law is the regulation of employment services, i.e. relations arising from the exercise of the right of natural persons to work. The relations arising in particular between natural persons and the relevant employment offices, as well as the relations arising between the relevant employment offices and employers, are also labour law relations, even though they are of a public law nature.

Labour law as a separate branch of the legal order, which is exceptional in its hybrid nature, consisting of both private and public law elements, is also exceptional in the enumeration and definition of its formal sources. These include normative legal acts; collective agreements; in-house normative acts; technical norms; good morals; international treaties; legally binding acts of the European Union.

The subject of the study is the labour law institutes of other countries (mainly the member states of the European Union and the Council of Europe), as well as their implementation in the application practice. The comparative examination of the legal regulation and the implementation of labour law institutes allows for proposing appropriate solutions for the legal regulation of these relations also within the framework of the national legislation of the Slovak Republic. Labour law is a vivid field, which is perhaps the most influenced by social changes. The link between the academic environment and the application practice is a prerequisite for the correct and desired functioning of the labour market. 

Interdisciplinary relations taken into account within the field of "Labor law", including social security law and health law, mainly include civil law, administrative law, psychology, political science or sociology, as well as economic sciences.
