Compatibility of the international jurisdiction of civil courts of the Slovak Republic, APVV-24-0613

The project focuses on a comprehensive doctrinal assessment of the national legislation on the international jurisdiction of Slovak courts, examining its compatibility with the international obligations of the Slovak Republic, the law of the European Union and the recodified Civil Procedure law. The importance of the project lies in the task of identifying application problems, evaluating the current regulation in comparison with the legal systems of selected EU member states and formulating de lege ferenda proposals. The ultimate goal is to identify problematic national standards causing incompatibility and to propose their modification in order to achieve their harmonization with the international obligations of the Slovak Republic. The project consists of three phases Analysis of the legal framework of international jurisdiction - examining the legal rules at international, EU and national level, including the impact of international law and the case law of the ECtHR. Examination of the objectives of national legislation and Slovak practice, and comparison with legislative approaches in selected EU Member States. The effectiveness of national legislation will be examined on the basis of an analysis of Slovak court decisions or a questionnaire survey. Formulation of de lege ferenda proposals - Synthesis of research findings and elaboration of proposals for legislative changes to improve national legislation on international jurisdiction of Slovak courts. The project will be implemented through legal analysis, legal comparison, empirical research and synthesis of results. The outputs of the project will be scientific articles in domestic and foreign peer-reviewed scientific journals, a scientific monograph and an international scientific conference. The results of the project will contribute to the increase of legal certainty in the field of international jurisdiction of Slovak courts, to the improvement of application practice and to the development of the science.
