Employee Privacy Protection in the Era of Digitalization and AI

Number of the project: UK/1081/2026

Principal Investigator:  Mgr. Soňa Kašická

The proposed research project focuses on the protection of employees’ privacy in the context of digitalization and the growing use of artificial intelligence in employment relationships. Particular emphasis is placed on the legal challenges related to the processing of personal data, electronic monitoring in the workplace, and algorithmic assessment of work performance, all of which significantly impact employees’ fundamental rights. The project also takes into account the current development of case law of the European Court of Human Rights, which responds to changing technological and social conditions and advances the interpretation of the right to privacy, as the boundaries between work and private life begin to blur. The research also includes an analysis of the impacts and requirements of the Artificial Intelligence Act. The aim of the project is a comprehensive analysis of the legal-theoretical foundations of employee privacy protection, an examination of the limits of legitimate interventions by employers, and an assessment of the risks arising from digitalization and the use of artificial intelligence. Special attention is given to a comparative analysis of the legal frameworks in the member states of the European Union. The results of the project will contribute to a better understanding of the legal, ethical, and technological limits of employee privacy protection and provide a basis for identifying shortcomings and formulating de lege ferenda recommendations, particularly in the context of the Slovak Republic.
