Roman Litigation under Conditions of Normative Pluralism. Jurisdiction, Competence, and Strategic Influence on Proceedings

Number of the project: UK/1094/2026

Principal Investigator:  Mgr. Veronika Blatnická

The project focuses on the study of Roman litigation in Rome and the provinces, with primary emphasis on the determination of jurisdiction and competence and their impact on the efficiency and expedition of proceedings. One of the partial aims of the project is to identify parallels between the situation in the Roman provinces and the mechanisms of modern private international law. Another partial aim is to examine how normative pluralism in the provinces and the rules governing jurisdiction and competence in Roman law allowed for strategic influence on proceedings by the parties, for example in the form of forum shopping, and to analyse the actual occurrence of such conduct in primary sources. The selected methods include textual analysis of primary sources and their interpretation considering the social realities of the provinces, as well as textual analysis of secondary literature and a comparative method based on comparing the provincial situation with modern private international law. The results of the project will be used in the researcher’s doctoral dissertation and will also be published as independent outputs in the form of scholarly articles or conference papers.
