Legal and Ethical Aspects of Disciplinary Liability of Judges

Number of the project: UK/1406/2026

Principal Investigator: Mgr. Ema Mikulová

The Supreme Administrative Court has been operating since 2021 and has introduced significant changes in the field of judicial disciplinary liability, primarily through the transfer of powers from disciplinary panels organisationally and technically administered by the Judicial Council of the Slovak Republic to the Supreme Administrative Court. These changes raise questions as to what they have brought about, how they have contributed to the enforcement of judicial disciplinary liability, and thus how they have affected disciplinary proceedings against judges overall. These issues will be examined through a partial analysis of data drawn from the decision-making activity of the Supreme Administrative Court for the period from 1 August 2021 to 31 July 2025, and from the period in which disciplinary panels administered by the Judicial Council of the Slovak Republic decided cases from 1 July 2017 to 31 July 2021. The analysis will primarily focus on selected indicators within individual decisions, such as the type of disciplinary sanction imposed and the type of disciplinary offence, on the basis of which conclusions concerning the enforcement of judicial disciplinary liability may be drawn. The aim of the project is to contribute to the current state of knowledge and to provide at least a partial insight into the state of judicial disciplinary liability through the lens of the decision-making activity of the relevant adjudicatory authorities within the defined period.
