The Illusion of Data Protection? Legal Challenges of Cybersecurity and Personal Data Protection in IT Law
Number of the project: UK/1435/2026
Principal Investigator: Mgr. Stela Košťálová
This project examines whether EU legislative measures in cybersecurity and data protection are safeguarding against digital threats. In the context of EU Law, the project focuses on key regulations like General Data Protection and the NIS 2 Directive, which have become cornerstones of data protection and cybersecurity in the EU. The project will dive into the extent to which these legal frameworks protect personal data from misuse and how member states implement these rules in practice. The project also explores potential gaps in the enforcement of these legal frameworks and their inconsistent application across EU countries such as Germany, Austria and Belgium. The aim of this project is not only to identify weaknesses in data protection but also to highlight how cybersecurity can be exploited. The results may provide recommendations for improving legislation, ensuring better protection of digital rights in the future and its presentation on various conferences.
