Konferencia: Súkromnoprávne vymáhanie súťažného práva a pravidiel verejného obstarávania v krajinách strednej a východnej Európy
Dňa 16. decembra 2025 sa na pôde fakulty uskutoční vedecká konferencia zameraná na aktuálne otázky súkromnoprávneho presadzovania pravidiel hospodárskej súťaže a verejného obstarávania v kontexte vybraných štátov v regiónoch strednej a východnej Európskej únie. Konferencia nadväzuje na tematické okruhy spracované v pripravovanej vedeckej monografii, ktorá rozširuje tradičné vnímanie private enforcement v oblasti antitrustu aj o problematiku súkromnoprávneho uplatňovania pravidiel štátnej pomoci - oblasti, ktorá je v porovnaní s presadzovaním antitrustových pravidiel ešte výraznejšie poddimenzovaná.
Podujatie ponúkne prierezové porovnanie mechanizmov súkromného presadzovania práva hospodárskej súťaže a verejného obstarávania. V oboch oblastiach sleduje spoločnú líniu vývoja - od "judikatórnej harmonizácie" zo strany Súdneho dvora EÚ až po súčasné limity a výzvy efektívneho uplatňovania nárokov na náhradu škody. Diskusia sa zameria najmä na základné prvky zodpovednosti za škodu, otázky kvantifikácie ujmy, účinky správnych a súdnych rozhodnutí či odporúčania pre ďalší rozvoj právnej úpravy a aplikačnej praxe.
Konferenčné príspevky reflektujú rozdielnu mieru rozpracovanosti jednotlivých právnych poriadkov v regióne, čo zodpovedá aj zloženiu autorského kolektívu pripravovanej publikácie. Predstavené budú nové poznatky o transpozícii a aplikácii smernice Európskeho parlamentu a Rady 2014/104/EÚ z 26. novembra 2014 o určitých pravidlách upravujúcich žaloby podľa vnútroštátneho práva o náhradu škody utrpenej v dôsledku porušenia ustanovení práva hospodárskej súťaže členských štátov a Európskej únie, ako aj komplexnejšie spracovanie problematiky náhrady škody, neplatnosti zmlúv a zodpovednosti štátu v kontexte verejného obstarávania, kde je "súkromné presadzovanie" tradične menej rozvinuté.
Konferencia je financovaná s podporou projektu VEGA 1/0710/23 "Náhrada škody v hospodárskej súťaži a verejnom obstarávaní - limity a výzvy účinného presadzovania práva Európskej únie".
