About the project

Current issues of parental maintenance obligation towards children

Principal Investigator: doc. Mgr. Lenka Dufalová, PhD.

Implementation: 2024 - 2026

The maintenance obligation of the parents towards the child can be considered as the most important of the maintenance obligations regulated by the Family Act. It results from the primary position of this obligation in the Family Act and from the specific position of the minor child as a weaker subject of the parent-child legal relationship. In connection with the child support, a wide range of questions appears in legal practice and jurisprudence. Legal regulation and subsequent application and interpretation of the law should be uniform and should lead to generally applicable conclusions respecting the principle of legal certainty. The objective of the presented project is the analysis of the legal regulation of the maintenance obligation of parents towards children de lege lata, the analysis of the relevant legal practice, the definition of problematic issues and the submission of a proposal for a conceptual solution of the legal regulation of the maintenance obligation of parents towards the children.
