About the project

International Child Abduction in the Practice of Slovak Courts

Principal investigator: prof. JUDr. PhDr. Miroslav Slašťan, PhD.

Implementation: 2026 - 2027

TThe project focuses on the civil aspects of international child abduction and examines the legislation contained in existing international conventions binding on the Slovak Republic, as well as Regulation Brussels IIb and its predecessors, the related national legislation, and the case law of the ordinary courts and the Constitutional Court of the Slovak Republic. The objective is to provide a critical analysis of the development of legislation and judicial practice in the Slovak Republic, to assess whether subsequent legislative reforms have addressed the shortcomings identified in earlier frameworks, and to offer de lege ferenda proposals. Special attention is devoted to the impact of the case law of the European Court of Human Rights (ECtHR) in this area. With the aim of formulating conclusions regarding examples of good practice by Slovak authorities that could serve as inspiration for foreign courts, the project also includes a comparative examination of foreign legislation.
