About the project
Legal and ethical aspects of disciplinary liability in the rule of law
Principal investigator: prof. JUDr. Mgr. Martina Gajdošová, PhD.
Implementation: 2023 - 2026
Due to its specificity, disciplinary liability is still one of the least scientifically processed types of legal liability. The central theme of the project is the identification and definition of the doctrinal approach to disciplinary liability and the conceptual definition of the entities implementing disciplinary liability and the entities to which disciplinary liability is derived, taking into account: typology, nature of processes, nature of tasks they pursue; the presence of a degree of self-government and state participation in these processes both in its legal and ethical dimension, as a functional component of the rule of law. The ambition of the project is to carry out analytical research of the decisions of the disciplinary senates and thus to support and supplement the doctrinal starting points. The topicality of the topic is highlighted by the forthcoming reform of the judiciary and the subordination of the exercise of disciplinary powers over some professions to the newly established Court.
