About the project
Private law guarantees of legal protection for disadvantaged individuals – vulnerable adults, in exercising their legal personality
Principal Investigator: prof. JUDr. Alexandra Löwy, PhD., LL.M
Implementation: 2024 - 2026
The stagnation of the recodification of private law in the conditions of the Slovak Republic reasonably raises questions related to the effectiveness of legal protection mechanisms in the level of private law relations and their subjects. The above resonates from the point of view of those natural persons who suffer from a certain handicap. This can be linked either to a health handicap, but also, for example, to the attainment of a certain age (seniors). The scientific research will focus on the analysis of the de lege lata situation in relation to the existence of legal guarantees and the functionality of the institutes that our legal system identifies in relation to persons who can be subsumed under the heading of 'vulnerable adults'.The confrontation of outcomes will also be set through a comparative analysis of modern legal arrangements in the Central European area, especially in relation to the institution of guardianship, but also other possible legal instruments for the protection of their status.
